\u00dccret \u00e7al\u0131\u015fanlar\u0131n en \u00f6nemli ge\u00e7im kayna\u011f\u0131d\u0131r ve korunmaya muhta\u00e7t\u0131r. Bu sebeple T\u00fcrk hukuk sisteminde anayasal koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r.[1] Uluslararas\u0131 d\u00fczeye bakt\u0131\u011f\u0131m\u0131zda da \u00fccret ile ilgili \u00e7ok say\u0131da tavsiye kararlar\u0131 ve d\u00fczenlemeler g\u00f6rmekteyiz. Uluslararas\u0131 d\u00fczeydeki en \u00f6nemli d\u00fczenleme ise, Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc (ILO) taraf\u0131ndan 8 Haziran 1949 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren ve \u00fclkemiz taraf\u0131ndan da onaylanm\u0131\u015f olan 95 say\u0131l\u0131 \u00dccretin Korunmas\u0131 S\u00f6zle\u015fmesi\u2019dir.[2] Ulusal d\u00fczeyde ise bir\u00e7ok kanunda \u00fccret ile ilgili h\u00fck\u00fcmler bulunmakla birlikte esas itibariyle d\u00fczenleyici ve emredici h\u00fck\u00fcmler 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda[3] yer almaktad\u0131r.<\/p>\n

\u0130\u015f Kanunu<\/span><\/strong>\u2019nda i\u015f\u00e7i \u00fccretlerini koruma alt\u0131na alan \u00e7ok \u00e7e\u015fitli d\u00fczenlemeler yer almaktad\u0131r. Bunlardan birisi de i\u015f\u00e7ilerin \u00fccretlerinin \u00f6deme zaman\u0131d\u0131r. Bilindi\u011fi \u00fczere 5580 say\u0131l\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Kanununa<\/span><\/strong>[4] tabi olarak kurumlarda g\u00f6rev yapan y\u00f6netici, \u00f6\u011fretmen, uzman \u00f6\u011fretici ve usta \u00f6\u011freticiler, 5580 say\u0131l\u0131 Kanun h\u00fck\u00fcmleri sakl\u0131 kalmak \u00fczere Sosyal g\u00fcvenlik ve \u00f6zl\u00fck haklar\u0131 y\u00f6n\u00fcnden; 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu[5] ile 4857 say\u0131l\u0131 \u0130\u015f Kanunu<\/span><\/strong>\u2019nun h\u00fck\u00fcmlerine tabidir. Bu \u00f6zelli\u011fi nedeni ile \u00f6zel \u00f6\u011fretim kurumlar\u0131nda \u00e7al\u0131\u015fan e\u011fitim personelinin \u00fccret \u00f6deme zaman\u0131 normal i\u015f\u00e7ilerden daha farkl\u0131 hukuki yorumlar gerektirebilmektedir.<\/p>\n

\u00c7al\u0131\u015fmada \u00fccret kavram\u0131 a\u00e7\u0131kland\u0131ktan sonra \u00f6zel okul \u00f6\u011fretmenlerinin 5580 say\u0131l\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Kanunu ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu h\u00fck\u00fcmlerinin kar\u015f\u0131la\u015ft\u0131r\u0131lmas\u0131 sonucu \u00fccret \u00f6deme zamanlar\u0131n\u0131n ne oldu\u011fu \u00fczerinde durulacakt\u0131r.<\/p>\n

\u00dccret<\/h4>\n

\u00dccret i\u015f s\u00f6zle\u015fmesinin esasl\u0131 ve en \u00f6nemli unsurudur. Kural olarak yap\u0131lan her i\u015f bir \u00fccreti gerektirir ve i\u015f\u00e7inin de bu \u00fccreti sonradan talep etme hakk\u0131 vard\u0131r.[6]<\/p>\n

5510 say\u0131l\u0131 Sosyal Sigortalar Ve Genel Sa\u011fl\u0131k\u00a0Sigortas\u0131 Kanunu<\/span><\/strong>\u2019nun tan\u0131mlar ba\u015fl\u0131kl\u0131 3.maddesine g\u00f6re \u00fccret \u201c4 \u00fcnc\u00fc maddenin birinci f\u0131kras\u0131n\u0131n (a) ve (c) bendi kapsam\u0131nda sigortal\u0131 say\u0131lanlara saatlik, g\u00fcnl\u00fck, haftal\u0131k, ayl\u0131k veya y\u0131ll\u0131k olarak para ile \u00f6denen ve s\u00fcreklilik niteli\u011fi ta\u015f\u0131yan br\u00fct tutar\u0131 ifade eder.<\/em>\u201d<\/p>\n

T\u00fcrkiye\u2019nin de onaylad\u0131\u011f\u0131 Uluslararas\u0131 \u00c7al\u0131\u015fma \u00d6rg\u00fct\u00fc\u2018n\u00fcn 95 Say\u0131l\u0131 \u00dccretin Korunmas\u0131 Hakk\u0131ndaki S\u00f6zle\u015fmesi \u00fccreti tan\u0131mlam\u0131\u015f ve bu anlamda g\u00fcvence alt\u0131na alm\u0131\u015ft\u0131r. \u201c\u00dccret, yap\u0131lan veya yap\u0131lacak olan bir i\u015f i\u00e7in veyahut g\u00f6r\u00fclen veya g\u00f6r\u00fclecek bir i\u015f i\u00e7in yaz\u0131l\u0131 veya s\u00f6zl\u00fc i\u015f akdi gere\u011fince bir i\u015fveren taraf\u0131ndan bir i\u015f\u00e7iye her ne nam alt\u0131nda ve hangi hesaplama \u015fekliyle olursa olsun \u00f6denmesi gereken ve nakden de\u011ferlendirilmesi kabil olup kar\u015f\u0131l\u0131kl\u0131 anla\u015fma veya mevzuatla tespit edilen bedel veya kazan\u00e7t\u0131r.<\/em>\u201d<\/p>\n

4857 say\u0131l\u0131 \u0130\u015f Yasas\u0131n\u0131n 32.maddesine g\u00f6re ise \u201cGenel anlamda \u00fccret bir kimseye bir i\u015f kar\u015f\u0131l\u0131\u011f\u0131nda i\u015fveren veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan sa\u011flanan ve para ile \u00f6denen tutard\u0131r.\u201d<\/em><\/p>\n

\u00d6zel Okul \u00d6\u011fretmenlerinin \u00dccret \u00d6deme Zaman\u0131<\/h4>\n

\u0130\u015f\u00e7i \u00fccretlerinin \u00f6denme zaman\u0131 \u0130\u015f Kanunun 32.maddesinde d\u00fczenlenmi\u015ftir. \u00dccret ve \u00dccretin \u00d6denmesi ba\u015fl\u0131kl\u0131 madde metnine g\u00f6re, \u201c\u00dccret en ge\u00e7 ayda bir \u00f6denir. \u0130\u015f s\u00f6zle\u015fmeleri veya toplu i\u015f s\u00f6zle\u015fmeleri ile bu s\u00fcre bir haftaya kadar indirilebilir\u2019<\/em>\u2019 denilmektedir. Ayn\u0131 yasan\u0131n 37. maddesi ise yap\u0131lan \u00f6demelerde \u00fccret hesap pusulas\u0131 d\u00fczenleme zorunlulu\u011funu getirmi\u015f ve an\u0131lan pusulada g\u00f6sterilmesi zorunlu hususlardan birisi olarak \u201c ili\u015fkin oldu\u011fu d\u00f6nem<\/u><\/em>\u201d i belirtmi\u015ftir.\u00a0 Yine ayn\u0131 yasan\u0131n 34. maddesi \u201c\u00dccreti \u00f6deme g\u00fcn\u00fcnden itibaren<\/u> yirmi g\u00fcn i\u00e7inde zorunlu bir sebep d\u0131\u015f\u0131nda \u00f6denmeyen i\u015f\u00e7i, i\u015f g\u00f6rme borcunu yerine getirmekten ka\u00e7\u0131nabilir. Bu nedenle ki\u015fisel kararlar\u0131na dayanarak i\u015f g\u00f6rme borcunu yerine getirmemeleri say\u0131sal olarak toplu bir nitelik kazansa dahi grev olarak nitelendirilemez\u2026\u201d\u00a0 <\/em>d\u00fczenlemelerine yer vermi\u015ftir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere Kanunun madde metinlerinin muhtevas\u0131na bak\u0131ld\u0131\u011f\u0131nda \u00fccretin \u00f6deme g\u00fcn\u00fcn\u00fcn belirlenmedi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n

Kanunda belirlenmi\u015f olan \u00fccret \u00f6deme zaman\u0131d\u0131r. \u00dccret \u00f6deme zaman\u0131na ili\u015fkin k\u0131s\u0131t ise en ge\u00e7 ayda bir olaca\u011f\u0131d\u0131r. Di\u011fer mevzuatlara bakt\u0131\u011f\u0131m\u0131zda da 4857 say\u0131l\u0131 Yasa ile paralel \u015fekilde \u201c muntazaman fas\u0131lalarla,\u00a0 her ay \u00f6dedikleri, bordronun ili\u015fkin oldu\u011fu ay\u201d gibi \u00fccret \u00f6deme g\u00fcn\u00fcnden ziyade \u00fccret \u00f6deme zaman\u0131n\u0131n \u00e7er\u00e7evesinin \u00e7izildi\u011fini, \u00fccret \u00f6deme g\u00fcn\u00fcn\u00fc ise taraflar\u0131n iradesine b\u0131rakt\u0131\u011f\u0131n\u0131 g\u00f6rmekteyiz. Yani i\u015f\u00e7i ve i\u015fveren \u00fccretin hangi zaman aral\u0131\u011f\u0131nda ve hangi g\u00fcn \u00f6denece\u011fini belirleme serbestine sahiptir. Ancak bu serbesti mutlak olmay\u0131p 32.maddede belirtildi\u011fi gibi en ge\u00e7 bir ayl\u0131k ve en erken bir haftal\u0131k \u00f6deme d\u00f6nemleri ile s\u0131n\u0131rlanm\u0131\u015ft\u0131r. Bu ba\u011flamda Kanunda i\u015f\u00e7i \u00fccretlerinin ay\u0131n 1\u2019inde, 15\u2019inde ya da ay sonunda \u00f6denmesine ili\u015fkin bir h\u00fck\u00fcm yoktur. \u0130\u015f s\u00f6zle\u015fmeleri ile i\u015fveren yapt\u0131\u011f\u0131 i\u015fin mahiyetine ve nakit ak\u0131\u015f durumuna g\u00f6re ay i\u00e7inde (\u00f6deme d\u00f6nemine ait ba\u011flay\u0131c\u0131 h\u00fck\u00fcmlere uymak kayd\u0131 ile) herhangi bir g\u00fcn belirleyebilir. Ayda bir \u00f6deme usul\u00fc se\u00e7ilmi\u015f ise \u00fccretlerin \u00f6denmesinde bir ayl\u0131k zaman diliminin ge\u00e7irilmemesi gerekmektedir.<\/p>\n

Bununla birlikte bilindi\u011fi \u00fczere e\u011fitim personeli esas itibariyle 5580 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine tabidir. 5580 say\u0131l\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Kanunu \u00d6zl\u00fck Haklar\u0131 ve Sorumluluklar ba\u015fl\u0131kl\u0131 9.maddesinde:<\/p>\n

\u201c Kurumlarda g\u00f6rev yapan y\u00f6netici, \u00f6\u011fretmen, uzman \u00f6\u011fretici ve usta \u00f6\u011freticiler, bu Kanun h\u00fck\u00fcmleri sakl\u0131 kalmak \u00fczere<\/strong>;<\/em><\/p>\n

a) Sosyal g\u00fcvenlik ve \u00f6zl\u00fck haklar\u0131 y\u00f6n\u00fcnden; 506 say\u0131l\u0131 Sosyal Sigortalar Kanunu ile\u00a0\u00a04857 say\u0131l\u0131 \u0130\u015f Kanunu,<\/em><\/p>\n

b) Yetki, sorumluluk, \u00f6d\u00fcl ve cezalar ile bunlar\u0131n uygulanmas\u0131 bak\u0131m\u0131ndan; 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu, 1702 say\u0131l\u0131 \u0130lk ve Orta Tedrisat Muallimlerinin Terfi ve Tecziyeleri Hakk\u0131nda Kanun, 4357 say\u0131l\u0131 Hususi \u0130darelerden Maa\u015f Alan \u0130lkokul \u00d6\u011fretmenlerinin Kadrolar\u0131na Terfi, Taltif ve Cezaland\u0131r\u0131lmalar\u0131na ve Bu \u00d6\u011fretmenler \u0130\u00e7in Te\u015fkil Edilecek Sa\u011fl\u0131k ve \u0130\u00e7tima\u00ee Yard\u0131m Sand\u0131\u011f\u0131 ile Yap\u0131 Sand\u0131\u011f\u0131na ve \u00d6\u011fretmenlerin Alacaklar\u0131na Dair Kanun ile 4483 say\u0131l\u0131 Memurlar ve Di\u011fer Kamu G\u00f6revlilerinin Yarg\u0131lanmas\u0131 Hakk\u0131nda Kanun,<\/em><\/p>\n

h\u00fck\u00fcmlerine t\u00e2bidir.\u201d<\/em> demektedir.<\/p>\n

Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Y\u00f6netmeli\u011fi\u2019nin eki olan \u201c\u00d6zel \u00d6\u011fretim Kurumlar\u0131nda G\u00f6rev Alan E\u011fitim Personeline Ait \u0130\u015f S\u00f6zle\u015fmesi Formunda\u201d \u00fccret \u00f6deme zaman\u0131na ili\u015fkin olarak \u00f6zel bir d\u00fczenleme yap\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Formun 5. maddesinin d f\u0131kras\u0131nda ki d\u00fczenlemede; \u201cE\u011fitim personelinin ayl\u0131k \u00fccreti, bordro ile her ay sonunda \u00f6denir.\u201d h\u00fckm\u00fc yer almaktad\u0131r. Yani mevzuatta yer alan d\u00fczenleme ile e\u011fitim personelinin \u00fccret \u00f6deme zaman\u0131 taraflar\u0131n iradesine b\u0131rak\u0131lmam\u0131\u015f, do\u011frudan y\u00f6netmelik ekinde yer alan tip s\u00f6zle\u015fme ile belirlenmi\u015ftir. E\u011fitim personeli i\u00e7in tabi olunan 5580 say\u0131l\u0131 Kanun 4857 say\u0131l\u0131 \u0130\u015f Kanuna g\u00f6re daha \u00f6zel bir kanundur. Bu nedenle \u00f6zl\u00fck haklar\u0131 a\u00e7\u0131s\u0131ndan e\u011fitim personelinin ilk olarak \u00a0\u00a05580 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine bak\u0131lacak ve Kanunda herhangi bir d\u00fczenleme yer almamas\u0131 durumunda 4857 say\u0131l\u0131 \u0130\u015f Kanunu h\u00fck\u00fcmlerine g\u00f6re i\u015flem yap\u0131lacakt\u0131r. T\u00fcm bu de\u011ferlendirmeler alt\u0131nda e\u011fitim personelinin \u00fccret \u00f6deme zaman\u0131 en ge\u00e7 her ay\u0131n sonunda olacak \u015fekilde<\/u><\/strong> d\u00fczenlenmesi gerekmektedir.<\/p>\n

\u0130\u015fin ola\u011fan ak\u0131\u015f\u0131 \u00e7er\u00e7evesinde \u00f6deme zaman\u0131ndaki 1-2 g\u00fcnl\u00fck sarkmalar i\u015fverenin kast\u0131 bulunmad\u0131\u011f\u0131 s\u00fcrece \u00fccret \u00f6deme zaman\u0131n\u0131n gecikmesi olarak de\u011ferlendirilmez.<\/p>\n

\u2014 Yarg\u0131tay[7], \u201c\u00dccret \u00e7al\u0131\u015f\u0131lan ay\u0131 takip eden ay ba\u015f\u0131nda muaccel hale gelmektedir\u201d<\/p>\n

\u2014 Antalya 1.Sulh Ceza Mah. T: 27.08.2008, E: 2008\/1408, Takip eden ay\u0131n 5 ve 6.g\u00fcn\u00fc yap\u0131lan \u00f6demeye ili\u015fkin idari para cezas\u0131n\u0131 yerinde bulmu\u015ftur.<\/p>\n

\u2014 Antalya 2. Sulh Ceza Mah. K.T: 2012\/83 nolu karar\u0131nda s\u00f6zle\u015fmede belli bir g\u00fcn belirtilmi\u015f olsa da s\u00f6zle\u015fme g\u00fcn\u00fcnde yap\u0131lan \u00f6demenin ayda bir \u00f6dendi\u011fini g\u00f6stermedi\u011fi y\u00f6n\u00fcnde h\u00fck\u00fcm vermi\u015ftir.<\/p>\n

E\u011fitim personelinin \u00fccretlerinin her ay\u0131n sonunda \u00f6denmemesi durumunda ise \u00fccretin ge\u00e7 \u00f6denmesi kabahati ile kar\u015f\u0131la\u015f\u0131lacakt\u0131r. Bu kabahatin yapt\u0131r\u0131m\u0131 ise bu durumda olan her bir i\u015f\u00e7i ve her ay i\u00e7in (i\u015f\u00e7iye ayl\u0131k \u00fccretinin \u00f6denmi\u015f olmas\u0131na bak\u0131lmaks\u0131z\u0131n) 2018 y\u0131l\u0131nda 191,00-TL idari para cezas\u0131 uygulanacakt\u0131r.<\/p>\n

[1] Anayasa 55.madde: \u201c\u00dccret eme\u011fin kar\u015f\u0131l\u0131\u011f\u0131d\u0131r. Devlet, \u00e7al\u0131\u015fanlar\u0131n yapt\u0131klar\u0131 i\u015fe uygun adaletli bir \u00fccret elde etmeleri ve di\u011fer sosyal yard\u0131mlardan yaralanmalar\u0131 i\u00e7in gerekli tedbirleri al\u0131r.\u201d<\/em><\/p>\n
