\u00c7al\u0131\u015fma hayat\u0131nda yer alan hemen hemen her i\u015f\u00e7i i\u00e7in fazla \u00e7al\u0131\u015fma konusu bir sorun te\u015fkil etmektedir. \u0130\u015fveren taraf\u0131ndan yap\u0131lan fazla \u00e7al\u0131\u015fma \u00fccretinin eksik \u00f6denmesi veya hi\u00e7 \u00f6denmemesi gibi uyu\u015fmazl\u0131klara \u00e7ok\u00e7a rastlan\u0131lmaktad\u0131r. Yine i\u015f mahkemelerine y\u00f6nelik davalarda ilk s\u0131rada fazla \u00e7al\u0131\u015fmaya ili\u015fkin uyu\u015fmazl\u0131klar yer almaktad\u0131r. ALO 170 arac\u0131l\u0131\u011f\u0131 ile yap\u0131lan \u015fikayetlerde de fazla \u00e7al\u0131\u015fma \u00fccreti konusunun ilk s\u0131ralarda yer ald\u0131\u011f\u0131 bilinmektedir.<\/p>\n

\u0130\u015f mevzuat\u0131nda en \u00f6nemli hususlardan birisi de yap\u0131lan i\u015f ve i\u015fin niteli\u011finin gerektirdi\u011fi \u00e7al\u0131\u015fma sistemidir. Her sekt\u00f6r kendi ihtiya\u00e7lar\u0131na y\u00f6nelik olarak en uygun \u00e7al\u0131\u015fma modelini i\u015fyerlerinde uygulamaktad\u0131r. \u0130\u015fte bu noktada da i\u015f mevzuat\u0131nda yer alan hususlar ile hayat\u0131n ola\u011fan ak\u0131\u015f\u0131 \u00e7er\u00e7evesindeki uyu\u015fmazl\u0131klar\u0131n kar\u015f\u0131 kar\u015f\u0131ya geldi\u011fini g\u00f6rmekteyiz.<\/p>\n

Bu \u00e7al\u0131\u015fman\u0131n amac\u0131 yerle\u015fik ilke Yarg\u0131tay kararlar\u0131 \u00e7er\u00e7evesinde \u00fcst d\u00fczey y\u00f6neticilerin, home ofis \u00e7al\u0131\u015fanlar\u0131n, sat\u0131\u015f temsilcilerinin ve turizm tesislerinde \u00e7al\u0131\u015fanlar\u0131n fazla \u00e7al\u0131\u015fmaya ili\u015fkin haklar\u0131n\u0131 aktarmakt\u0131r.<\/p>\n

1- \u00dcst D\u00fczey Y\u00f6neticiler (Ma\u011faza M\u00fcd\u00fcrleri, \u015eantiye \u015eefleri)<\/strong><\/p>\n

\u0130\u015fyerinde \u00fcst d\u00fczey y\u00f6netici konumda \u00e7al\u0131\u015fan i\u015f\u00e7i, g\u00f6rev ve sorumluluklar\u0131n\u0131n gerektirdi\u011fi \u00fccretinin \u00f6denmesi durumunda, ayr\u0131ca fazla \u00e7al\u0131\u015fma \u00fccretine hak kazanamaz. Bununla birlikte \u00fcst d\u00fczey y\u00f6netici konumunda olan i\u015f\u00e7iye ayn\u0131 yerde g\u00f6rev ve talimat veren bir ba\u015fka y\u00f6netici ya da \u015firket orta\u011f\u0131 bulunmas\u0131 halinde, i\u015f\u00e7inin \u00e7al\u0131\u015fma g\u00fcn ve saatlerini kendisinin belirledi\u011finden s\u00f6z edilemeyece\u011finden, yasal s\u0131n\u0131rlamalar\u0131 a\u015fan \u00e7al\u0131\u015fmalar i\u00e7in fazla \u00e7al\u0131\u015fma \u00fccreti talep hakk\u0131 do\u011far.[1] O halde \u00fcst d\u00fczey y\u00f6netici bak\u0131m\u0131ndan \u015firketin y\u00f6neticisi veya y\u00f6netim kurulu \u00fcyesi taraf\u0131ndan fazla \u00e7al\u0131\u015fma yapmas\u0131 y\u00f6n\u00fcnde bir talimat\u0131n verilip verilmedi\u011finin de ara\u015ft\u0131r\u0131lmas\u0131 gerekir.\u00a0\u0130\u015fyerinde y\u00fcksek \u00fccret alarak g\u00f6rev yapan \u00fcst d\u00fczey y\u00f6neticiye i\u015fveren taraf\u0131ndan fazla \u00e7al\u0131\u015fma yapmas\u0131 y\u00f6n\u00fcnde a\u00e7\u0131k bir talimat verilmemi\u015fse, g\u00f6revinin gere\u011fi gibi yerine getirilmesi noktas\u0131nda kendisinin belirledi\u011fi \u00e7al\u0131\u015fma saatleri sebebiyle fazla \u00e7al\u0131\u015fma \u00fccreti talep edemeyece\u011fi kabul edilmelidir.[2]<\/p>\n

Bu kararlar alt\u0131nda \u00fcst d\u00fczey y\u00f6neticilerin fazla \u00e7al\u0131\u015fma \u00fccreti talep edebilmeleri i\u00e7in Yarg\u0131tay iki \u00f6nemli kriter aramaktad\u0131r. Bunlardan ilkini \u00fcst d\u00fczey y\u00f6netici konumunda \u00e7al\u0131\u015fan i\u015f\u00e7iye g\u00f6rev ve sorumluluklar\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olacak d\u00fczeyde bir \u00fccret \u00f6denmesi olu\u015fturur. \u0130kincisini ise \u00fcst d\u00fczey y\u00f6neticiye fazla \u00e7al\u0131\u015fma yap\u0131p yapmayaca\u011f\u0131 hususunda emir ve talimat verme yetkisine haiz daha \u00fcst bir konumda bulunan \u015firket y\u00f6neticisi, b\u00f6lge sorumlusu vb. konumda bulunan ba\u015fka birisinin varl\u0131\u011f\u0131d\u0131r. Bu iki ko\u015fulun yer almas\u0131 halinde \u00fcst d\u00fczey y\u00f6neticilerin de fazla \u00e7al\u0131\u015fma \u00fccreti talep hakk\u0131 bulunmaktad\u0131r.<\/p>\n

Ma\u011faza m\u00fcd\u00fcrleri ve \u015fantiye \u015fefleri a\u00e7\u0131s\u0131ndan fazla \u00e7al\u0131\u015fma \u00fccretine hak kazan\u0131p kazanmad\u0131klar\u0131 hususunda ise y\u00fcksek mahkeme \u00fcst d\u00fczey y\u00f6neticiler ile ayn\u0131 \u015fartlar\u0131 aramaktad\u0131r.[3]<\/p>\n

2- Home Ofis \u00c7al\u0131\u015fanlar, Sat\u0131\u015f Temsilcileri ve Ticari M\u00fcmessiller<\/strong><\/p>\n

4857 say\u0131l\u0131 \u0130\u015f Kanunu<\/span><\/strong>\u2019nun 32\u2019nci maddesinin ilk f\u0131kras\u0131na g\u00f6re, genel anlamda \u00fccret, bir kimseye bir i\u015f kar\u015f\u0131l\u0131\u011f\u0131nda i\u015fveren veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan sa\u011flanan ve para ile \u00f6denen tutar olarak tan\u0131mlanm\u0131\u015ft\u0131r. Yasada \u00fccretin eklerinin neler oldu\u011fu m\u00fcstakilen d\u00fczenlenmemi\u015f olmakla birlikte, de\u011finilen maddenin ikinci f\u0131kras\u0131ndaki \u201c\u2026banka hesab\u0131na yat\u0131r\u0131lacak \u00fccret, prim, ikramiye ve bu nitelikteki her \u00e7e\u015fit istihkak\u0131n\u0131n.<\/em>..\u201d ibaresi gere\u011fince, \u00fccretin yan\u0131 s\u0131ra prim, ikramiye ve bu nitelikteki her t\u00fcrl\u00fc \u00f6demelerin banka hesab\u0131na yat\u0131r\u0131lmas\u0131 \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fcnden, \u201cprim<\/strong>\u201d ve \u201cikramiye<\/strong>\u201d \u00fccretin eki olarak \u0130\u015f Kanunu\u2019nda ifadesini bulmu\u015ftur.[4]<\/p>\n

Prim, i\u015f\u00e7inin mal veya hizmet \u00fcretiminde daha istekli hale gelmesi ve ba\u015far\u0131s\u0131n\u0131n artmas\u0131 i\u00e7in i\u015fverence \u00f6d\u00fcl niteli\u011finde verilen ek \u00f6demeler \u015feklinde tan\u0131mlanabilir. Prim \u00f6demesinden ama\u00e7, i\u015f\u00e7inin dava verimli bir \u015fekilde \u00e7al\u0131\u015fmaya \u00f6zendirilmesidir. Pirimin ki\u015fiye \u00f6zg\u00fc olmas\u0131 sebebiyle ikramiyeden farkl\u0131 olarak prim \u00f6demelerinin genel bir nitelik ta\u015f\u0131mas\u0131 gerekmez. Bununla birlikte, i\u015fveren taraf\u0131ndan ayr\u0131m\u0131 hakl\u0131 k\u0131lan ge\u00e7erli nedenler olmad\u0131\u011f\u0131 s\u00fcrece pirim uygulamas\u0131 y\u00f6n\u00fcnden de i\u015fverenin e\u015fit davranma borcu s\u00f6z konusudur. \u0130\u015f\u00e7inin prime hak kazanmas\u0131 i\u00e7in i\u015fyerinde pirim \u00f6demesini gerektiren d\u00f6nemin sonuna kadar \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131 gerekmez. \u0130\u015fyerinde \u00e7al\u0131\u015f\u0131lan s\u00fcreyle s\u0131n\u0131rl\u0131 olmak \u00fczere i\u015f\u00e7inin prim talep hakk\u0131 vard\u0131r.<\/p>\n

Fazla \u00e7al\u0131\u015fman\u0131n ispat\u0131 konusunda i\u015fyeri kay\u0131tlar\u0131, \u00f6zellikle i\u015fyerine giri\u015f \u00e7\u0131k\u0131\u015f\u0131 g\u00f6steren belgeler, i\u015fyeri i\u00e7 yaz\u0131\u015fmalar\u0131 delil niteli\u011findedir. Ancak, fazla \u00e7al\u0131\u015fman\u0131n yaz\u0131l\u0131 belgelerle kan\u0131tlanamamas\u0131 durumunda taraflar\u0131n, tan\u0131k beyanlar\u0131 ile sonuca gidilmesi gerekir. Bunun d\u0131\u015f\u0131nda herkes\u00e7e bilinen genel baz\u0131 vak\u0131alar da bu noktada g\u00f6z \u00f6n\u00fcne al\u0131nabilir. \u0130\u015f\u00e7inin fiilen yapt\u0131\u011f\u0131 i\u015fin niteli\u011fi ve yo\u011funlu\u011funa g\u00f6re de fazla \u00e7al\u0131\u015fma olup olmad\u0131\u011f\u0131 ara\u015ft\u0131r\u0131lmal\u0131d\u0131r.[5]<\/p>\n

Sat\u0131\u015f temsilcilerinin, home ofis \u00e7al\u0131\u015fanlar\u0131n\u0131n ve ticari m\u00fcmessillerin fazla \u00e7al\u0131\u015fma yap\u0131p yapmad\u0131klar\u0131 hususu, g\u00fcnl\u00fck faaliyet planlar\u0131 ile i\u015f \u00e7izelgeleri de dikkate al\u0131narak belirlenmelidir. Genelde belli hedeflerin ger\u00e7ekle\u015fmesine ba\u011fl\u0131 olarak prim kar\u015f\u0131l\u0131\u011f\u0131 \u00e7al\u0131\u015fan bu i\u015f\u00e7iler y\u00f6n\u00fcnden prim \u00f6demelerinin fazla \u00e7al\u0131\u015fmay\u0131 kar\u015f\u0131lay\u0131p kar\u015f\u0131lamad\u0131\u011f\u0131 ara\u015ft\u0131r\u0131lmal\u0131d\u0131r. \u0130\u015f\u00e7iye \u00f6denen sat\u0131\u015f priminin fazla \u00e7al\u0131\u015fmalar\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda \u00f6denmesi gereken \u00fccretleri tam olarak kar\u015f\u0131lamamas\u0131 halinde aradaki fark\u0131n i\u015f\u00e7iye \u00f6denmesi gerekir.[6]<\/p>\n

Sat\u0131\u015f temsilcilerinin, home ofis \u00e7al\u0131\u015fanlar\u0131n\u0131n ve ticari m\u00fcmessillerin fazla \u00e7al\u0131\u015fma \u00fccretine ili\u015fkin taleplerinde Yarg\u0131tay kararlar\u0131 nezdinde iki temel hususun \u00f6nem arz etti\u011fi g\u00f6r\u00fclmektedir. Bunlardan ilkini, i\u015f\u00e7inin \u00e7al\u0131\u015fma saatlerini kendi inisiyatifi ile belirleyip belirlemedi\u011fi hususudur. Di\u011feri ise i\u015fveren taraf\u0131ndan i\u015f\u00e7iye bir \u00e7al\u0131\u015fma program\u0131, i\u015f plan\u0131 g\u00fcnl\u00fck eylem \u00e7izelgesi gibi bir program verilip bunun denetiminin yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131d\u0131r. E\u011fer i\u015f\u00e7i \u00e7al\u0131\u015fma s\u00fcresini kendisi belirleyemiyorsa ve i\u015fveren taraf\u0131ndan bir program akabinde ve buna uyup uymad\u0131\u011f\u0131n\u0131n denetimi yap\u0131larak \u00e7al\u0131\u015ft\u0131r\u0131l\u0131yorsa fazla \u00e7al\u0131\u015fma \u00fccretine hak kazanacakt\u0131r.<\/p>\n

3- Turizm Tesislerinde \u00c7al\u0131\u015fanlar<\/strong><\/p>\n

Turizm tesisleri faaliyette olduklar\u0131 turistik alana g\u00f6re genellikle mevsimsel olarak faaliyet g\u00f6steren i\u015fyerleridir. Kimi turistik tesisler k\u0131\u015f\u0131n (kayak gibi faaliyetler \u00fczerine i\u015fletilen i\u015fyerlerinde) kimileri de yaz\u0131n (oteller gibi) yo\u011fun olarak faaliyette bulunmaktad\u0131rlar. Hatta bu i\u015fyerlerinde \u00e7al\u0131\u015fan i\u015f\u00e7iler ile mevsimlik i\u015f s\u00f6zle\u015fmeleri d\u00fczenlenmektedir. \u0130\u015f\u00e7iler turizm sezonu boyunca, ki bu k\u0131\u015f ya da yaz d\u00f6nemi ile s\u0131n\u0131rl\u0131 olmak \u00fczere, \u00e7al\u0131\u015f\u0131rlar ve daha sonraki d\u00f6neme kadar i\u015fyerinde ba\u015fkaca bir faaliyette bulunmazlar. Turizm tesislerinde fazla \u00e7al\u0131\u015fma yap\u0131ld\u0131\u011f\u0131na ili\u015fkin uyu\u015fmazl\u0131klar da yo\u011fun olarak faaliyet g\u00f6sterilen d\u00f6nemlerde \u00e7ok\u00e7a g\u00f6r\u00fclmektedir. Yarg\u0131tay\u2019da yap\u0131lan i\u015f, i\u015fin niteli\u011fi, faaliyette olunan d\u00f6nem gibi k\u0131staslar\u0131 g\u00f6z \u00f6n\u00fcnde bulundurarak turistik tesislerde \u00e7al\u0131\u015fanlar\u0131n fazla \u00e7al\u0131\u015fma taleplerine ili\u015fkin ilke kararlar getirmi\u015ftir: Turizm tesisi olan i\u015fyerlerinde yap\u0131lan i\u015fin s\u00fcrekli olmamas\u0131 hususu da g\u00f6z \u00f6n\u00fcnde bulundurularak fazla \u00e7al\u0131\u015fman\u0131n hesaplanmas\u0131 gerekmektedir. Bu tarz i\u015fyerlerinde yo\u011fun olarak \u00e7al\u0131\u015f\u0131lan d\u00f6nem tespit edilerek sadece bu d\u00f6nem i\u00e7in fazla \u00e7al\u0131\u015fma \u00fccreti kabul edilmelidir.[7]<\/p>\n

Sonu\u00e7<\/h4>\n

Fazla \u00e7al\u0131\u015fma ya da di\u011fer uyu\u015fmazl\u0131klarda \u00f6ncelikle her konunun kendi \u00f6zelinde de\u011ferlendirilmesi gerekti\u011fi unutulmamal\u0131d\u0131r.
