I. \u0130PTAL\u0130 \u0130STENEN KANUN H\u00dcK\u00dcMLER\u0130<\/strong><\/p>\n

\u0130ptali istenen kurallar\u0131n yer ald\u0131\u011f\u0131 6715 say\u0131l\u0131 Kanun\u2019un;<\/p>\n

1.1. maddesiyle de\u011fi\u015ftirilen 4857 say\u0131l\u0131 Kanun\u2019un 7. maddesi \u015f\u00f6yledir:<\/p>\n

“Ge\u00e7ici i\u015f ili\u015fkisi<\/em><\/p>\n

Madde 7- Ge\u00e7ici i\u015f ili\u015fkisi, \u00f6zel istihdam b\u00fcrosu arac\u0131l\u0131\u011f\u0131yla ya da holding b\u00fcnyesi i\u00e7inde veya ayn\u0131 \u015firketler toplulu\u011funa ba\u011fl\u0131 ba\u015fka bir i\u015fyerinde g\u00f6revlendirme yap\u0131lmak suretiyle kurulabilir.<\/em><\/p>\n

\u00d6zel istihdam b\u00fcrosu arac\u0131l\u0131\u011f\u0131yla ge\u00e7ici i\u015f ili\u015fkisi, T\u00fcrkiye \u0130\u015f Kurumunca izin verilen \u00f6zel istihdam b\u00fcrosunun bir i\u015fverenle ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi yaparak bir i\u015f\u00e7isini ge\u00e7ici olarak bu i\u015fverene devri ile;<\/em><\/p>\n

a) Bu Kanunun 13 \u00fcnc\u00fc maddesinin be\u015finci f\u0131kras\u0131 ile 74 \u00fcnc\u00fc maddesinde belirtilen h\u00e2llerde, i\u015f\u00e7inin askerlik hizmeti h\u00e2linde ve i\u015f s\u00f6zle\u015fmesinin ask\u0131da kald\u0131\u011f\u0131 di\u011fer h\u00e2llerde,<\/em><\/p>\n

b) Mevsimlik tar\u0131m i\u015flerinde,<\/em><\/p>\n

cj Ev hizmetlerinde,<\/em><\/p>\n

d) \u0130\u015fletmenin g\u00fcnl\u00fck i\u015flerinden say\u0131lmayan ve aral\u0131kl\u0131 olarak g\u00f6rd\u00fcr\u00fclen<\/em><\/p>\n

i\u015flerde,<\/em><\/p>\n

e) \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi bak\u0131m\u0131ndan acil olan i\u015flerde veya \u00fcretimi \u00f6nemli \u00f6l\u00e7\u00fcde etkileyen zorlay\u0131c\u0131 nedenlerin ortaya \u00e7\u0131kmas\u0131 h\u00e2linde,<\/em><\/p>\n

f) \u0130\u015fletmenin ortalama mal ve hizmet \u00fcretim kapasitesinin ge\u00e7ici i\u015f ili\u015fkisi kurulmas\u0131n\u0131 gerektirecek \u00f6l\u00e7\u00fcde ve \u00f6ng\u00f6r\u00fclemeyen \u015fekilde artmas\u0131 h\u00e2linde,<\/em><\/p>\n

g) Mevsimlik i\u015fler hari\u00e7 d\u00f6nemsellik arz eden i\u015f art\u0131\u015ftan h\u00e2linde,<\/em><\/p>\n

kurulabilir.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi ikinci f\u0131kran\u0131n (a) bendinde say\u0131lan h\u00e2llerin devam\u0131 s\u00fcresince, (b) ve (c) bentlerinde say\u0131lan h\u00e2llerde s\u00fcre s\u0131n\u0131r\u0131 olmaks\u0131z\u0131n, di\u011fer bentlerde say\u0131lan h\u00e2llerde ise en fazla d\u00f6rt ay s\u00fcreyle kurulabilir. Yap\u0131lan bu s\u00f6zle\u015fme ikinci f\u0131kran\u0131n (g) bendi hari\u00e7 toplam seki: ay\u0131 ge\u00e7memek \u00fczere en fazla iki defa yenilenebilir. Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, belirtilen s\u00fcrenin sonunda ayn\u0131 i\u015f i\u00e7in alt\u0131 ay ge\u00e7medik\u00e7e yemden ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ramaz.<\/em><\/p>\n

Bu Kanunun 29 uncu maddesi kapsam\u0131nda toplu i\u015f\u00e7i \u00e7\u0131kar\u0131lan i\u015fyerlerinde sekiz ay s\u00fcresince, kamu kurum ve kurulu\u015flar\u0131nda ve yer alt\u0131nda maden \u00e7\u0131kar\u0131lan i\u015fyerlerinde bu maddenin ikinci f\u0131kras\u0131 kapsam\u0131nda ge\u00e7ici i\u015f ili\u015fkisi kurulamaz.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, grev ve lokavt\u0131n uygulanmas\u0131 s\u0131ras\u0131nda 18\/10\/2012 tarihli ve 6356 say\u0131l\u0131 Sendikalar ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanununun 65 inci maddesi h\u00fck\u00fcmleri sakl\u0131 kalmak kayd\u0131yla ge\u00e7ici i\u015f ili\u015fkisiyle i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ramaz.<\/em><\/p>\n

\u0130kinci f\u0131kran\u0131n (f) bendi kapsam\u0131nda ge\u00e7ici i\u015f ili\u015fkisi ile \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7i say\u0131s\u0131, i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7i say\u0131s\u0131n\u0131n d\u00f6rtte birini ge\u00e7emez. Ancak, on ve daha az i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015fyerlerinde be\u015f i\u015f\u00e7iye kadar ge\u00e7ici i\u015f ili\u015fkisi kurulabilir, i\u015f\u00e7i say\u0131s\u0131n\u0131n tespitinde, k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesine g\u00f6re \u00e7al\u0131\u015fanlar, \u00e7al\u0131\u015fma s\u00fcreleri dikkate al\u0131narak tam s\u00fcreli \u00e7al\u0131\u015fmaya d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcr. Ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan i\u015f\u00e7i, 30 uncu maddenin uygulanmas\u0131nda \u00f6zel istihdam b\u00fcrosu ve ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fverenin i\u015f\u00e7i say\u0131s\u0131na d\u00e2hil edilmez.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, i\u015f s\u00f6zle\u015fmesi feshedilen i\u015f\u00e7isini fesih tarihinden itibaren alt\u0131 ay ge\u00e7meden ge\u00e7ici i\u015f ili\u015fkisi kapsam\u0131nda \u00e7al\u0131\u015ft\u0131ramaz.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7i, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fverenden \u00f6zel istihdam b\u00fcrosunun hizmet bedeline mahsup edilmek \u00fczere avans veya bor\u00e7 alamaz.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren;<\/em><\/p>\n

a) \u0130\u015fin gere\u011fi ve ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesine uygun olarak ge\u00e7ici i\u015f\u00e7isine talimat verme yetkisine sahiptir.<\/em><\/p>\n

b) \u0130\u015fyerindeki a\u00e7\u0131k i\u015f pozisyonlar\u0131n\u0131 ge\u00e7ici i\u015f\u00e7isine bildirmek ve T\u00fcrkiye \u0130\u015f Kurumu taraf\u0131ndan istenecek belgeleri belirlenen s\u00fcrelerle saklamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n

c) Ge\u00e7ici i\u015f\u00e7inin i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 h\u00e2llerini \u00f6zel istihdam b\u00fcrosuna derh\u00e2l, 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 13 \u00fcnc\u00fc ve 14 \u00fcnc\u00fc maddelerine g\u00f6re ilgili mercilere bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n

d) Ge\u00e7ici i\u015f\u00e7ileri \u00e7al\u0131\u015ft\u0131klar\u0131 d\u00f6nemlerde, i\u015fyerindeki sosyal hizmetlerden e\u015fit muamele ilkesince yararland\u0131r\u0131r. Ge\u00e7ici i\u015f\u00e7iler, \u00e7al\u0131\u015fmad\u0131klar\u0131 d\u00f6nemlerde ise \u00f6zel istihdam b\u00fcrosundaki e\u011fitim ve \u00e7ocuk bak\u0131m hizmetlerinden yararland\u0131r\u0131l\u0131r.<\/em><\/p>\n

e) \u0130\u015fyerindeki ge\u00e7ici i\u015f\u00e7ilerin istihdam durumuna ili\u015fkin bilgileri varsa i\u015fyeri sendika temsilcisine bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n

f) 20\/6\/2012 tarihli ve 6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanununun 17 nci maddesinin alt\u0131nc\u0131 f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen e\u011fitimleri vermekle ve i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan gereken tedbirleri almakla, ge\u00e7ici i\u015f\u00e7i de bu e\u011fitimlere kat\u0131lmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7inin, ge\u00e7ici i\u015f\u00e7iyi \u00e7al\u0131\u015ft\u0131ran i\u015fverenin i\u015fyerindeki \u00e7al\u0131\u015fma s\u00fcresince temel \u00e7al\u0131\u015fma ko\u015fullar\u0131, bu i\u015f\u00e7ilerin ayn\u0131 i\u015fveren taraf\u0131ndan ayn\u0131 i\u015f i\u00e7in do\u011frudan istihdam\u0131 h\u00e2linde sa\u011flanacak ko\u015fullar\u0131n alt\u0131nda olamaz.<\/em><\/p>\n

Ge\u00e7ici i\u015f ili\u015fkisinde i\u015fveren \u00f6zel istihdam b\u00fcrosudur. \u00d6zel istihdam b\u00fcrosu arac\u0131l\u0131\u011f\u0131yla ge\u00e7ici i\u015f ili\u015fkisi, ge\u00e7ici i\u015f\u00e7i ile i\u015f s\u00f6zle\u015fmesi, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren ile ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi yapmak suretiyle yaz\u0131l\u0131 olarak kurulur. \u00d6zel istihdam b\u00fcrosu ile ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren aras\u0131nda yap\u0131lacak ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesinde; s\u00f6zle\u015fmenin ba\u015flang\u0131\u00e7 ve biti\u015f tarihi, i\u015fin niteli\u011fi, \u00f6zel istihdam b\u00fcrosunun hizmet bedeli, varsa ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fverenin ve \u00f6zel istihdam b\u00fcrosunun \u00f6zel y\u00fck\u00fcml\u00fcl\u00fckleri yer al\u0131r. Ge\u00e7ici i\u015f\u00e7inin, T\u00fcrkiye \u0130\u015f Kurumundan veya bir ba\u015fka \u00f6zel istihdam b\u00fcrosundan hizmet almas\u0131n\u0131 ya da i\u015f g\u00f6rme edimini yerine getirdikten sonra ge\u00e7ici i\u015f\u00e7i olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fveren veya farkl\u0131 bir i\u015fverenin i\u015fyerinde \u00e7al\u0131\u015fmas\u0131n\u0131 engelleyen h\u00fck\u00fcmler konulamaz. Ge\u00e7ici i\u015f\u00e7i ile yap\u0131lacak i\u015f s\u00f6zle\u015fmesinde, i\u015f\u00e7inin ne kadar s\u00fcre i\u00e7erisinde i\u015fe \u00e7a\u011fr\u0131lmazsa hakl\u0131 nedenle i\u015f s\u00f6zle\u015fmesini feshedebilece\u011fi belirtilir. Bu s\u00fcre \u00fc\u00e7 ay\u0131 ge\u00e7emez.<\/em><\/p>\n

\u0130kinci f\u0131kran\u0131n (f) bendi kapsam\u0131nda kurulan ge\u00e7ici i\u015f ili\u015fkisinde, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren i\u015fyerinde bir ay\u0131n \u00fczerinde \u00e7al\u0131\u015fan ge\u00e7ici i\u015f\u00e7ilerin \u00fccretlerinin \u00f6denip \u00f6denmedi\u011fini \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre boyunca her ay kontrol etmekle, \u00f6zel istihdam b\u00fcrosu ise \u00fccretin \u00f6dendi\u011fini g\u00f6steren belgeleri ayl\u0131k olarak ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fverene ibraz etmekle y\u00fck\u00fcml\u00fcd\u00fcr. Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, \u00f6denmeyen \u00fccretler mevcut ise bunlar \u00f6denene kadar \u00f6zel istihdam b\u00fcrosunun alaca\u011f\u0131n\u0131 \u00f6demeyerek, \u00f6zel istihdam b\u00fcrosunun alaca\u011f\u0131ndan mahsup etmek kayd\u0131yla ge\u00e7ici i\u015f\u00e7ilerin en \u00e7ok \u00fc\u00e7 aya kadar olan \u00fccretlerini do\u011frudan\u00a0i\u015f\u00e7ilerin banka hesab\u0131na yat\u0131r\u0131r. \u00dccreti \u00f6denmeyen i\u015f\u00e7iler ve \u00f6denmeyen \u00fccret tutarlar\u0131 ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015fma ve i\u015f kurumu il m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirilir.<\/em><\/p>\n

S\u00f6zle\u015fmede belirtilen s\u00fcrenin dolmas\u0131na ra\u011fmen ge\u00e7ici i\u015f ili\u015fkisinin devam etmesi h\u00e2linde, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren ile i\u015f\u00e7i aras\u0131nda s\u00f6zle\u015fmenin sona erme tarihinden itibaren belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi kurulmu\u015f say\u0131l\u0131r. Bu durumda \u00f6zel istihdam b\u00fcrosu i\u015f\u00e7inin ge\u00e7ici i\u015f ili\u015fkisinden kaynaklanan \u00fccretinden, i\u015f\u00e7iyi g\u00f6zetme borcundan ve sosyal sigorta primlerinden s\u00f6zle\u015fme s\u00fcresiyle s\u0131n\u0131rl\u0131 olmak \u00fczere sorumludur.<\/em><\/p>\n

Ge\u00e7ici i\u015f\u00e7i, i\u015fyerine ve i\u015fe ili\u015fkin olmak kayd\u0131yla kusuru ile neden oldu\u011fu zarardan, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fverene kar\u015f\u0131 sorumludur.<\/em><\/p>\n

\u0130\u015fverenin, devir s\u0131ras\u0131nda yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 almak suretiyle bir i\u015f\u00e7isini, holding b\u00fcnyesi i\u00e7inde veya ayn\u0131 \u015firketler toplulu\u011funa ba\u011fl\u0131 ba\u015fka bir i\u015fyerinde i\u015f g\u00f6rme edimini yerine getirmek \u00fczere ge\u00e7ici olarak devretmesi h\u00e2linde de ge\u00e7ici i\u015f ili\u015fkisi kurulmu\u015f olur. Bu f\u0131kra kapsam\u0131nda ge\u00e7ici i\u015f ili\u015fkisi, yaz\u0131l\u0131 olarak alt\u0131 ay\u0131 ge\u00e7memek \u00fczere kurulabilir ve en fazla iki defa yenilenebilir. \u0130\u015f\u00e7isini ge\u00e7ici olarak devreden i\u015fverenin \u00fccret \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc devam eder. Ge\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fveren, i\u015f\u00e7inin kendisinde \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcrede \u00f6denmeyen \u00fccretinden, i\u015f\u00e7iyi g\u00f6zetme borcundan ve sosyal sigorta primlerinden, devreden i\u015fveren ile birlikte sorumludur. D\u00f6rd\u00fcnc\u00fc, be\u015finci, onuncu ve on d\u00f6rd\u00fcnc\u00fc f\u0131kralar ve dokuzuncu f\u0131kran\u0131n (a) ve (f) bentleri ile (d) bendinin birinci c\u00fcmlesinde d\u00fczenlenen hak ve y\u00fck\u00fcml\u00fcl\u00fckler bu f\u0131kraya g\u00f6re kurulan ge\u00e7ici i\u015f ili\u015fkisinde de uygulan\u0131r.<\/em><\/p>\n

2. 3. maddesiyle bir c\u00fcmlenin eklendi\u011fi ikinci f\u0131kran\u0131n yer ald\u0131\u011f\u0131 4857 say\u0131l\u0131 Kanun\u2019un 63. maddesi \u015f\u00f6yledir:<\/em><\/p>\n

6. \u00d6zel istihdam b\u00fcrolar\u0131n\u0131n ge\u00e7ici i\u015f ili\u015fkisi kurabilmeleri i\u00e7in T\u00fcrkiye \u0130\u015f Kurumundan yetki almalar\u0131 gerekmektedir. T\u00fcrkiye \u0130\u015f Kurumu taraf\u0131ndan \u00f6zel istihdam b\u00fcrolar\u0131na ge\u00e7ici i\u015f ili\u015fkisi kurabilmeleri i\u00e7in yetki verilmesi 4904 say\u0131l\u0131 T\u00fcrkiye \u0130\u015f Kurumu Kanunu\u2019nun 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda belirli ko\u015fullara ba\u011flanm\u0131\u015ft\u0131r. Bu d\u00fczenlemeye g\u00f6re ba\u015fvuru tarihinden \u00f6nceki iki y\u0131l s\u00fcresince kesintisiz faaliyet g\u00f6steren Kuruma kay\u0131tl\u0131 \u00f6zel istihdam b\u00fcrolar\u0131na; Kurumca yap\u0131lacak inceleme sonucunda olumlu rapor d\u00fczenlenmi\u015f olmas\u0131, ge\u00e7ici i\u015f ili\u015fkisi kurma yetkisi almak \u00fczere Kuruma ba\u015fvurulan tarihte br\u00fct asgari \u00fccret tutar\u0131n\u0131n iki y\u00fcz kat\u0131na denk gelen miktarda teminat verilmi\u015f olmas\u0131, Kurum alaca\u011f\u0131n\u0131n bulunmamas\u0131, \u00f6zel istihdam b\u00fcrosunun vadesi ge\u00e7mi\u015f vergi borcunun bulunmamas\u0131, Sosyal G\u00fcvenlik Kurumuna prim, idari para cezas\u0131 ve bunlara ili\u015fkin gecikme cezas\u0131 ve gecikme zamm\u0131 borcunun bulunmamas\u0131 veya vergi dairesine ve Sosyal G\u00fcvenlik Kurumuna olan borcunun 21.7.1953 tarihli ve 6183 say\u0131l\u0131 Amme Alacaklar\u0131n\u0131n Tahsil Usul\u00fc Hakk\u0131nda Kanun\u2019un 48. maddesine g\u00f6re tecil edilmi\u015f, taksitlendirilmi\u015f veya ilgili di\u011fer kanunlar uyar\u0131nca yeniden yap\u0131land\u0131r\u0131lm\u0131\u015f olmas\u0131 ve bu tecil, taksitlendirme ve yap\u0131land\u0131rmalar\u0131n devam etmesi ve uygun bir i\u015fyerine sahip olmas\u0131 h\u00e2llerinde ge\u00e7ici i\u015f ili\u015fkisi kurma yetkisi verilebilmektedir.<\/p>\n

Ayr\u0131ca \u00f6zel istihdam b\u00fcrosunun; i\u015f\u00e7i say\u0131s\u0131, i\u015f hacmi, faaliyet alan\u0131 ve \u015fube a\u00e7\u0131p a\u00e7mamas\u0131 gibi hususlar de\u011ferlendirilerek \u00f6ng\u00f6r\u00fclen teminat miktar\u0131n\u0131n yirmi kat\u0131na kadar art\u0131r\u0131lmas\u0131na \u00e7al\u0131\u015fma ve sosyal g\u00fcvenlik bakan\u0131 yetkilidir.<\/p>\n
